General aspects in the application of criminal procedure under Romanian legislation

Abstract

The criminal process is a procedure regulated by law by which the judicial authorities investigate and judge the facts considered crimes, in order to liable the guilty persons and to protect the innocent. In this sense, the criminal process is regulated in four phases: the criminal prosecution (which takes place on the fact, immediately after the notification, then regarding the person), the preliminary chamber, the judgment (in the first instance and, possibly, in the appeal route) and the execution of the final court decision. The present study debates the first stage of the criminal trial, respectively that of the procedure in the phase of criminal prosecution and follows is a small segment to acquire the knowledge about the way of applying the criminal procedure in this phase, of the criminal prosecution.
